We value the trust that you place in us by sharing your personal data with us. R-bies Co., Ltd. (“R-bies”) takes your privacy seriously and is committed to handling your personal data in a way that is fair and worthy of that trust. R-bies will take all reasonable steps to protect your information from misuse and to keep it secure.
We believe it is important to inform you about how we will use your personal data. Therefore, we encourage you to carefully read this privacy policy (“Policy”), which describes our privacy practices and the rights and choices you have regarding your personal data. We also encourage you to read possible additional privacy clauses that may be applicable when you use certain services or purchase certain products.

SCOPE

This Policy applies to all personal data we collect, use, disclose, or otherwise process about you, including when: (i) you create an account with RUNNET, Run Japan, Oen-navi, TATTA, e-moshicom, SPORTS TOWN WALKER or another account under our brands, (ii) you visit or use our websites, applications, or platforms, including online or other services of R-bies , (iii) you participate in events, running races or other activities hosted or operated by us, and (iv) you interact with us through social media or otherwise, online or offline (collectively the “Services”). Unless otherwise specified, this Policy also applies to personal data we collect about business customers (corporations or sole proprietors), vendors, and partners.

For purposes of this Policy, “personal data” means any information that relates to, describes, or is reasonably associated or linked to you, or through which we can identify you, as further described below in the section ‘Personal Data We Collect’.

WHO WE ARE

R-bies is a company headquartered in Japan with the mission of supporting people in leading healthy and fulfilling lives through sport. R-bies is part of the ASICS Group, which is headed by ASICS Corporation, ASICS Japan Corporation and other ASICS Group companies (an overview can be found here). The ASICS Group is headquartered in Japan and operates globally in the manufacture and sale of sporting goods.

R-bies is the responsible controller for the personal data we collect. As described in the section ‘How We Share Your Personal Data,’ we may also share and jointly use personal data with other ASICS Group companies in accordance with this Policy.

PERSONAL DATA WE COLLECT

We collect personal data about you: (i) directly, including automatically (for example when you access and use our websites or applications, see the section ‘Personal Data We Collect And Process Automatically’); and (ii) indirectly from third parties. We may also combine and process personal data from these sources in order to infer additional information about you. The personal data we collect may include the following, depending on the Services you use:

General:

Your (business) contact details.  Your name and contact details, such as your address, telephone number and email address.
Your account data (including data added thereto). Data related to your account or other accounts with our brands (RUNNET, Run Japan, Oen-navi, TATTA, SPORTS TOWN WALKER, e-moshicom), such as your account name or similar unique account identifier, email address, address, password, communications and content you provide in connection with the Services, order history, address book, payment settings, your date of birth, your gender, other preference settings, the country you live in, pictures and other information you may voluntarily share with us (such as your responses to voluntary questionnaires).
Your event registration and race result data. Data you provide when registering for races or events, as well as information you registered in connection with past race entries, such as your date of birth, email address, name and address, contact details (telephone number), gender, nationality, race result data (including the races you participated in, bib number, and finish times), club affiliation, athletics federation registration details, employer information (company name and telephone number), emergency contact details (name, telephone number and relationship), blood type, and passport number.
Your online purchase history. Data we collect when you purchase products through our Services, such as the amount and date of your purchase, the product purchased or Services used, your location, the website or application through which you make your purchase, the payment method, payment status, your invoice, order (tracking) number, the delivery method, the delivery and billing address and, if applicable, information about warranties and returns.

If you have chosen to create a RUNNET or Run Japan account via a third-party social media account such as Facebook, we will receive basic information retained by the relevant social media account, such as your email address. If you interact with us or publicly post content about us on social media sites, we may collect information about these interactions. These third-party platforms and services control the information they collect and share about you. For details on how they use and disclose your information, including information you make public, please refer to their respective privacy policies.

Information regarding your use of our online Services.  Data about the pages you visit on our websites, the products or services you like, the content of your abandoned shopping cart, and products browsed.
Details regarding your child(ren). Data we receive from you in relation to your child(ren) that we related to the Services, such as their name or nickname, age, gender or photo.
Your running data. Running data, you enter or generate when using our Services (such as TATTA) or that you import from third-party applications or services (such as Apple Health, Apple Watch or other fitness trackers), including your running distance, race times and performance records.
Your reviews and content. Personal data collected when you participate in or win a contest or prize promotion, such as your email address, name, address and gender.
Your reviews and content. Opinions, content, experiences, testimonials, preferences, interests, and product or event reviews that you publish on our Services or share with us online, through social media or otherwise, including your social media handle or other identifier(s), experiences and tips regarding races or events we organize or operate, and your race schedule.
Your images and recordings. We have security cameras in our offices which may record your image when you visit our premises. We may also film or take photos at events we organize or operate, or during specific interactions. You may also voluntarily submit photos or videos to us in connection with our Services.
Your communication data, including call recordings.  When you contact us for support or other customer service requests, including if we communicate with you via e-mail, chat, mail, or otherwise offline and online (e.g., via social media or in-store) or telephone we collect and maintain records of your request(s) and any complaints, including your name and contact information, the contents of your communications and our responses (including, where applicable, transcripts thereof), and any other data that we receive related to your inquiry. If you call us, we may, subject to and in accordance with local law, record, transcribe and retain recordings and copies of transcripts of such calls as well as maintain logs and records of your calls.
Data submitted to an insurer to enroll you as the insured under accident insurance or RUNNET Event Cancellation Insurance (including coverage for adverse weather or natural disasters).  Where we arrange such insurance, we collect the following with your consent at the time of entry: your date of birth, email address, name, postal address, contact details, gender, nationality, employer information, emergency contact details (name, telephone number, relationship), and blood type.
Health data. Data obtained if we provide you with medical assistance, such as the circumstances leading to the assistance, details of the medical care provided, and information about your health or any illness or injury.
Third-party service data. Data you authorize to share with us when linking your account to third-party services, such as your user ID and other information available within the relevant third-party service.
Organizer information.  Data about event organizers and their representatives required for transferring collected entry fees and verifying the authenticity of the organizer, such as the organizer’s name, registered address, bank account details, and the representative’s contact information (name, email address, telephone number).
App usage data. Data collected through your use of our apps during event participation, such as activity data (e.g., running distance or speed calculated from location data), location data, heart rate data (if connected to a watch), and data used to calculate your BMI (such as height, weight and step count).
Business partner contact details. Data about representatives of our business partners, including their name, postal address, telephone number and email address.
Exhibitors contact details. Data about representatives of companies exhibiting at our events, including their email address, address, name and company name.
Event collaborator information. Data collected from individuals supporting events we organize or operate (such as participants, pacers, medical runners, doctors, nurses and volunteers), including their name, gender, date of birth, postal code, address, email address, telephone number, nationality, and emergency contact details.
Event committee member information. Data about individuals involved in the organization or the operation of our events (such as members of an executive committee), including their name, gender, postal code, address, telephone number, email address, employer and job title.
Part-time staff information. Data about part-time staff engaged at our events, including their name, gender, date of birth, postal code, address, email address, telephone number, bank account details and nearest station.
Timing staff information. Data about staff responsible for race timing, including their name, date of birth, email address, access or registration data, address, contact details, gender and bank account details.

SPECIAL CATEGORIES OF PERSONAL DATA

We also collect personal data you voluntarily provide to us in relation to your health in order to recommend, customize and enhance your experience when using our Services.
Such personal data may – by itself or in combination – reveal information about your (physical) health, which could be considered ‘special categories of personal data’ under certain laws. The special categories of personal data include:

Activity data and other data you provide when using the Services.  Such data may include your height, weight, step count and injuries.
Measurement data. Measurement data we collect when you participate in events operated by us. Such measurement data may include your BMI.

In addition, depending on the Services you use and with your consent, we may also collect and use information regarding your location, such as GPS data or your running route (including precise location data that shows your geographical position).

Where required under applicable law, we will only collect and use health and location data if you voluntarily share it with us, and with your prior consent or at your direction for the purposes set out in this Policy. You may refuse or revoke your consent at any time, as set out below in the section ‘Your Rights’.

PERSONAL DATA WE COLLECT AND PROCESS AUTOMATICALLY

Subject to local law requirements, we may also collect personal data about how you use our Services and your interactions with us, as well as your electronic identification data (collected via cookies, pixel tags, or similar technologies). This may include information about how you access, use and interact with our Services, your IP address, MAC address, mobile device identifier (IDFA or GAID), cookie ID, cookie content, browser type, browsing and click behaviors and other activities, purchase information, domain name, referrer URL, access dates and times, hardware and software information and settings, information about the device you use (e.g., device ID, device type), operating system, language settings, and approximate location inferred from your IP address (collectively, “electronic identification data”).
We may also use pixels in HTML email address we send to you to evaluate and improve our marketing email address. For example, we may use pixels to understand whether you read the email address we send to you. For more information, see the section ‘Cookies, Analytics and Personalization’ below.

HOW WE USE YOUR PERSONAL DATA

We use and process the personal data for the purposes set out below.

For the performance of our agreement with you. We process the personal data described above under “Personal Data We Collect” where necessary to perform our agreement(s) with you. This includes when you purchase a product or service online, use an application, sign up for a RUNNET account, a Run Japan account or another account with us, when we publish your race result data on RUNNET after your participation in an event, or otherwise request or use any of our Services.
The personal data we use for the performance of our agreement may include, for example, your (business) contact details, information regarding your online purchases, loyalty scheme information (where applicable), your account and electronic identification data, information regarding the Services you use, your interests and event registrations, information regarding your child(ren), your running data (including your fitness activities), your communication data, your race registration data, measured race result data, and – after your consent thereto – information regarding your activity, personal measurements, running data, and test and measurement results (excluding race result data), as well as data about your location (including your precise location data).
This also includes, for example, sending race or event participant kits, providing information regarding the race and on the event day, collecting and notifying information regarding applicants and recruitment results for race or event staff, making salary or compensation payments to race or event staff, sending subscribed magazines, and sending certificates of completion.
To comply with a legal obligation. Any data referred to above in the section ‘Personal Data We Collect’ may be used to maintain appropriate business records, to comply with lawful requests by public authorities, or to otherwise comply with applicable laws and regulations.
For our legitimate commercial interests. We will process the personal data referred to above in the section ‘Personal Data We Collect’ where we have a legitimate interest; for example, our interests could include the effective delivery of information, Services and products to you and the effective and lawful operation of our business (in each case provided such interests are not overridden by your rights).Specifically, we may use the personal data we collect about you (listed in the section ‘Personal Data We Collect’ above) for the following interests:
  • Improving our products and Services:to improve our products and Services as well as to better understand our customers both on an aggregated and on an individual basis. We do this by combining certain personal data we have obtained about you across our different Services and by analyzing your use of our products and Services. This enables us to improve our products and Services and provide you with a better user experience.
  • Advertising: to promote our products and Services and to enable us to provide, personalize, measure and improve our digital advertising. For example, we may use your personal data to show you suggestions and targeted advertising (including advertisements on third-party websites or social media) based on how you interact with us, or to create specific target audiences. To do this, we may share certain personal data (such as electronic identification data, telephone number and email address) with our advertising partners, including social media platforms such as Facebook, Instagram, Google, Snapchat and Pinterest.
  • Personalized experience:to personalize your experience of our Services. This may include:
    • Personalizing the recommendations we give you when you use our Services and creating personal profiles to enable us to send you personalized marketing materials and advertising about products and Services you may be interested in (if you have chosen to receive such materials);
    • Providing you with other optional benefits in our Services.
  • Analytics and statistics:to generate aggregated statistics and analytics about users of our products and Services and about visitors to our events.
  • Surveys and feedback:to obtain feedback on our products and other Services (for example, by conducting customer satisfaction surveys or research) and to use such feedback to develop and improve our products and Services.
  • Planning and managing events:to plan and manage the events and races we host or organize, including registration, attendance, invitations to connect with other participants, and communications regarding related events and Services.
  • Security:to process certain personal data for the purposes of security, fraud prevention and detection, and to maintain the integrity of our systems (e.g., preventing hacking, fraudulent activities or spam). We also use personal data when investigating misuse of our Services or other unlawful activities, as well as in cases of suspected unlawful conduct, potential threats to the safety or legal rights of individuals or third parties, or to take action regarding violations of this Policy or breaches of our applicable agreements and terms of use.
  • Business operations:to facilitate our business operations, to implement internal policies and procedures, and for mergers, business transfers, acquisitions or transfers of assets (including negotiations related thereto).
  • Other purposes:to use personal data for other legitimate business purposes as permitted under applicable law.

To the extent that we rely on our legitimate interests as a legal basis for processing your personal data, you have the right to object to such processing. We must stop processing your personal data unless we can demonstrate either (1) compelling legitimate grounds that, in light of your interests, rights and freedoms, override them, or (2) that processing is necessary for the establishment, exercise or defense of legal claims (see the section ‘Your Rights’ below).

Use of information based on your consent We may also process your personal data where you have provided your consent for specific purposes. This may include:
  • We may use the personal data referred to above in the section ‘Special Categories of Personal Data’ (for example, health and location data) for the purposes set out in this Policy.
  • We may use the personal data referred to above in the section ‘Personal Data We Collect’ where consent is required under applicable law for:
    • direct marketing purposes via email, SMS, push notification, or other electronic means;
    • recording customer service calls for quality and management purposes;
  • Where required under applicable law, we will ask for your consent before collecting and processing your electronic identification data. For more information, please see the section ‘Cookies, Analytics and Personalization’ below.
  • We may also ask for your consent to process certain personal data for other specific purposes. If we do so, we will provide you with details of the personal data we wish to process and the reasons for its collection and processing, so that you can carefully consider whether to consent.

To the extent that we rely on your consent as a legal basis for processing your personal data, you have the right to withdraw such consent at any time, as set out below in the section ‘Your Rights’. If you withdraw your consent, we will cease using your personal data for the purposes described under ‘Use of personal data based on your consent’, and therefore, it may become impossible for us to provide Services for those purposes.

HOW WE SHARE YOUR PERSONAL DATA

We may share your personal data with the following parties:

Service providers.  With contractors, agents, service providers and related entities that we engage to provide services to us and on our behalf, such as support for the operation of our websites (including payment processors and the shipping and fulfilment partners we use to process your orders), technical support, research, digital marketing, data storage and other services. In providing their services, these parties may access, collect, store or otherwise process your personal data on our behalf. We contractually prohibit these service providers from using your personal data for their own commercial purposes. Consistent with applicable legal requirements, we take commercially reasonable steps to require these parties to adequately safeguard your personal data and process it only in accordance with our instructions.
Partners. We may provide you with services, applications or promotions in co-operation with our partners or co-sponsors, or allow you to connect to third-party platforms and services using your RUNNET account or Run Japan account. In such cases, if you register for races or events we operate through your account or other accounts with our brands (including but not limited to RUNNET, Run Japan and e-moshicom), we may disclose to the relevant race or event organizer the personal data obtained through your registration. In other cases, we may disclose your personal data to relevant partners only where you have consented or requested that we do so, or where doing so is necessary to fulfil your request. If you do not wish your personal data to be shared, you may choose not to participate or otherwise object to such sharing.
Advertising or marketing partners.  We may share limited personal data (such as electronic identification data, contact information, country and conversion status) with our advertising partners, including social media platforms such as Facebook, X, Instagram, Google, Snapchat and Pinterest, to display suggestions and targeted advertising (including advertisements on third-party websites or social media platforms) based on how you interact with us, and to create specific target audiences.
Joint use. We may jointly use your personal data with other entities, in accordance with this Policy and the provisions set out under “Local Deviation – Japan” below.
Disclosure to third parties based on legal requirements. We may disclose your personal data if we determine that we are required to do so by law, if disclosure is necessary in accordance with legal procedures, or if we determine that it is necessary or appropriate to disclose your personal data to judicial or law enforcement authorities. This may include, for example, investigating actual or suspected fraud, violations of law, security breaches, or breaches of this Policy; responding to lawsuits or claims against us; protecting the rights, property, or personal safety of our company and our customers; or disclosure of information in public interest.
Corporate transactions. We may disclose personal data in connection with any actual or contemplated merger, sale, transfer of our assets, acquisition, bankruptcy, or other similar corporate transactions. This may include, where permitted by law, due diligence and negotiations conducted in advance of such transactions.
With consent. We may also disclose your personal data to other third parties where you have consented or requested us to do so.

Notwithstanding anything else in this Policy, we may collect, use and share aggregated or de-identified information with third parties for research (including academic presentations of research results), marketing, analysis, and other purposes, provided such information does not identify any individual. Where we use, disclose or process de-identified or anonymized information, we will maintain and use such information in a non-identifiable form and, except as required by applicable law, will not re-identify it.

COOKIES, ANALYTICS AND PERSONALIZATION

Subject to your prior consent (where required under applicable law), we and our service providers use cookies, clear GIFs/pixel tags, JavaScript, local storage, log files and other mechanisms to automatically collect and record information about your usage and browsing activities, your interactions with the Services, the content of your communications on the Services, and electronic identification data. We may also combine this “activity information” with other personal data we collect about you.

We generally use this information to understand how you use and interact with our Services, to track and troubleshoot bugs and errors, to improve and develop our Services, to verify account credentials, to enable logins, to track sessions, to prevent fraud, and to protect our Services, as well as for targeted marketing and advertising purposes, to customize content, for analysis, and for similar purposes.

Do-Not-Track.  Our websites do not respond to browser Do-Not-Track settings. However, as described in our Cookie Policy, you may disable certain cookies.

SOCIAL MEDIA

Our Services may contain links to third-party social networking sites or plugins to facilitate social media functions, which may collect your personal data. These third parties may collect information about you if you click on such links and may automatically record information about your browsing behavior each time you access their respective sites or services. If you participate in social media forums such as Facebook, X, Snapchat, Yammer, Pinterest, Instagram or LinkedIn, you should be familiar with and understand the tools and services of those sites, which allow you to choose how your personal data in your social media profile(s) is shared.
Please note that the privacy practices or privacy policies of these third parties – not this Policy – apply to the processing of your personal data by those social media platforms. Therefore, you should review the applicable privacy policies, terms of use and related information to understand how your personal data is used in those social media environments.
Also, depending on the settings you have made on such social media platforms (and in combination with your settings on our sites), we may share certain information about your online activities and social media profiles (such as your interests, marital status, gender, username, photo, and any comments or content you have posted or shared).

IF YOU ARE UNDER 16 YEARS OF AGE

If you are under sixteen (16) years of age, you must obtain the consent of your parents or legal guardian before providing your personal data to us. If we suspect that we have collected personal data from a child under sixteen (16) without a valid legal basis, we will delete such data. In such a case, please contact us (see the section ‘Contact And Queries’ below).

INTERNATIONAL TRANSFERS OF YOUR PERSONAL DATA

We transfer the personal data you provide to us to countries or regions outside your country or region of residence. Please be aware that in some of those countries or regions, the level of protection for personal data required by law may not be equivalent to that in your country or region of residence. We strive to implement appropriate safeguards for the protection of personal data and to comply with applicable laws in connection with such transfers.

For transfers of personal data from the European Economic Area (“EEA”) or the United Kingdom (“UK”) to countries that do not provide an adequate level of protection, we use intra-group data transfer agreements based on the EU Standard Contractual Clauses adopted by the European Commission (“Standard Contractual Clauses”) and other local legal data transfer provisions. Transfers of personal data obtained from the EEA or UK to recipients outside our organization are carried out on the basis of appropriate safeguards, such as the Standard Contractual Clauses or other approved data transfer or certification mechanisms, together with binding and enforceable commitments from the recipient. In each case, we assess the transfer and ensure the implementation of any additional technical and organizational measures to guarantee an adequate level of protection.

SECURITY

We implement technical, physical and organizational measures and controls to protect the personal data we collect from unauthorized or unlawful use, alteration, unauthorized access or disclosure, and accidental or intentional destruction or loss. While we make every effort to protect your personal data, please note that no absolute security measures exist that can guarantee complete protection. In addition to the measures we take, we ask you to take your own precautions to protect your account and personal data, such as not sharing your password, not using the same password across multiple websites, choosing passwords that are difficult to guess, and promptly contacting us if you become aware of any suspicious activity or unauthorized access to your account.

DATA RETENTION

We retain your personal data for as long as necessary to fulfill the purposes for which it was collected (for example, to process your orders, provide customer service, respond to your inquiries, or resolve technical issues), unless a longer retention period is required to comply with our legal obligations or to defend against legal claims.
If you have a RUNNET account, a Run Japan account or another account with us, and you request deletion of your account, we will delete your account and personal data within thirty (30) days after a certain period. When we delete your account, we may retain certain account information and related personal data for a longer period where necessary to comply with our legal obligations or to establish, exercise or defend our legal rights (including in connection with actual or potential legal claims).

YOUR RIGHTS

Subject to limitations and exceptions under applicable law, you may have the following rights regarding the personal data we collect about you:

The right to access. You have the right to request access to the personal data we hold about you, as well as information regarding the processing of your personal data.
The right to rectification. If the personal data we hold about you is inaccurate or incomplete, you have the right to request that it be updated or corrected.
The right to erasure. Except in cases where we are required by law to retain your personal data, where it is necessary to establish, exercise or defend legal claims, or where we have legitimate grounds to do so, you have the right to request the deletion of your personal data.
The right to object.  You have the right to object to our processing of your personal data, on grounds relating to your particular situation, where we process your personal data based on our legitimate interests (unless we can demonstrate compelling legitimate grounds to continue such processing). You also have the right to object at any time to the processing of your personal data for direct marketing purposes (for example, by clicking the unsubscribe link in our emails).
The right to withdraw consent. Where we process your personal data based on your consent, you have the right to withdraw such consent at any time with effect for the future.
  • This includes withdrawing your consent to receive marketing communications, which you can do by following the instructions provided in such communications. You can also manage these settings in the profile settings of your RUNNET or Run Japan account.
  • If you wish to withdraw your consent to the use of your health data and location data, you can manage these settings in your profile settings and on your device.
The right to restriction of processing. Under certain circumstances, you have the right to restrict our processing of your personal data, for example where (i) you believe that the personal data we hold about you is inaccurate; (ii) the personal data is not being processed lawfully, but instead of requesting deletion you prefer that we restrict its processing; or (iii) we no longer need your personal data for the purposes for which we collected it, but you consider that it is necessary for the establishment, exercise or defense of legal claims.
The right to data portability. Under certain circumstances, where we process your personal data on the basis of your consent or for the performance of a contract with you, and the processing is carried out by automated means, you have the right (i) to receive the personal data you have provided to us in a commonly used and machine-readable format, and (ii) to request that we transfer such data to a third party designated by you.

We will respond to your privacy rights requests in accordance with applicable law. For your protection and the protection of others, depending on the type of request, we may review its content and verify your identity before responding.
